Filed on December 22, 2025, the complaint accuses Curriculum Associates of violating multiple federal and state privacy laws by gathering sensitive student information through its digital learning tools. The plaintiffs are four California students represented by their parents who claim that the company collects data such as names, student IDs, grade levels, responses to academic questions, and IP addresses, and shares that data with third-party service providers without direct parental consent.
The lawsuit brings claims under several statutes, including the Federal Wiretap Act, the California Invasion of Privacy Act (CIPA), the California Comprehensive Computer Data Access and Fraud Act (CDAFA), and the Massachusetts Consumer Protection Act. Additional claims include negligence and unjust enrichment.
According to the complaint, Curriculum Associates allegedly transmits student data in real time to third-party vendors such as Google, Clever, and Munetrix, raising concerns about how that information may be used beyond educational purposes. Plaintiffs argue that these practices violate students’ privacy rights and expose them to potential risks, including data profiling and unauthorized data use.
Curriculum Associates has strongly denied the allegations. On February 27, 2026, the company filed a motion to dismiss the case, arguing that the lawsuit is part of what it describes as an “ideologically motivated crusade” to reshape how technology is used in schools through litigation rather than legislation.
In its filing, the company contends that its practices are fully compliant with existing laws and long-standing regulatory frameworks, particularly the Family Educational Rights and Privacy Act (FERPA). Under FERPA and similar state laws, schools are permitted to consent on behalf of parents to the collection and use of student data for legitimate educational purposes.
The company also challenges the legal foundation of the plaintiffs’ claims. It argues that its data collection does not constitute illegal “wiretapping” because a company cannot intercept its own communications with users. Additionally, it maintains that sharing data with service providers for functions such as hosting, analytics, and technical support does not amount to unlawful third-party interception.
On April 3, 2026, plaintiffs filed their opposition to the motion to dismiss, signaling that the legal dispute is far from resolved. The court’s upcoming decision on whether the case will proceed could have far-reaching implications for the edtech industry, particularly regarding how student data is collected, shared, and regulated.

Yes, its a waste of time. Especially for gifted students that have to wait a minute or so in between each question and if you get it wrong because youre going too fast, you have to let it talk at you for 5 minutes. Let the teachers choose their tools

Yeah, but misclicks happen, realizing the right answer right after you click a wrong one, or a simple mistake and it takes you back like 4 steps. I’ve always muted the tab when I have to use it. That voices is very annoying.

No you can’t because it is not the program itself that is giving you that stress, it could be because you hate it or are assigned the My-Path.

Yes, you can sue for anything, its winning that will be the hard part as if I ready was considered emotional distress the school system would not exist. I 100% agree though that I ready is dumb and a hurtful learning tool.

probably not. if you are a minor, you have to have your parents sue on your behalf, the case is likely better for the school district for not allowing you to opt out.

This app takes too much time to complete each lesson does not include interesting worksheets and does not allow students to fully learn to their full potential. Teachers deserve to use what tools they want because they’re already not getting paid enough. Students also have to take meaningless tests that the school districts pump up making it lockdown testing. Thank you.

Like seriously. I think they are waayyy to slowed down and dumbed down for it to be even mildly interesting. I genuinely flinched one time when I heard the I-ready’s narrator’s voice in public because someone was using it on their phone. IDK how I flinched like that even.
can we ban iready today
Finally, someone knows how us students feel. I-Ready has done absolutely nothing to help us learn. It just teaches stuff we already know. And I always knew that they were up to something behind those screens like selling our personal information and stuff.
I have been fighting my daughter’s school against IReady and all they say is district is making us. Teachers just use the time to take a break from teaching
As a teacher, I also despise iReady. Our district requires students to complete 45 minutes a week, and teachers must have 90% of students meeting that goal. It is such a waste of time. There really are better platforms that support student learning.
iReady is not a valid assessment. You can not assess 5 year olds phonological awareness on a computer, too easy for students to just click through, and it gives teachers no data on specific skills or the types of errors students make (which teachers need to know in order to tailor their instruction). It also does not align with state standards and does not use the same academic language as most curriculum (iReady uses the term ‘corner angle’ in its assessments instead of right angle).

If I make a mistake, eg. 20 instead of 10 it takes a whole yap session in order for me to answer again.
I actually have i-ready it’s just too much especially when they give 4 diagnostics a year and then state district gives writing assignments and CFAs and now, we have T-CAP and plus after t-cap we have I-ready diagnostics like if we don’t get I-ready destroyed I’m going to end up crashing out and destroying my student device that I’m typing on right now. plus, it’s just a waste of time and if we still have I-ready they need to get rid of some of these test.
I-ready doesn’t teach anything we learn it all in class, and even our ELA teacher doesn’t want I-ready
our school makes it a grade from our lesson scores, and we need 5 in reading and 3 in math so if you get bad scores your cooked
after I-ready gets banned, we have to go for IXL next because tell me why my teacher is assigning lessons due during t-cap and plus or scores go down so much when you make a mistake… and our math teacher makes us work the problems on paper and keep them because of cheating but there is still ways to cheat………
